Rent Agreement Format

The ‘Model tenancy Act’ 2021 was introduced with the primary motive of building a fair and transparent renting system in the country. The Act provides that a written agreement is required between the owner of the property and the tenant.

This written agreement is called Rent Agreement, a legal document specifying the conditions agreed by both owner and tenant for temporary possession of the property to the tenant. This legal document can help avoid disputes that might arise during or after the tenancy period.

Here a general format of the Rent Agreement India has been provided.

 

RENT AGREEMENT FORMAT:

This rent agreement is made on this ……………by ……………..(name) S/o …………, Address: (residential address of the landlord). Hereinafter called the Owner, (first party to the agreement).

AND

(The proposed company), through its proposed director (name of the director) called the Tenant, (second party to the agreement).

That the expression of the term, Owner and the Tenant shall mean and include their legal heirs, assigns, representatives, etc. Whereas the ownership of the property No: (registered address of the company) lies with the owner and has agreed to let out the one office room, one toilet & bathroom set on said property, to the Tenant and the Tenant has agreed to pay Rs. ______/- (in words) per month as rent for the same.

Now This Rent Agreement Witness as Under:

1. That the Tenant will have to pay Rs. ______/- (in words) as monthly rent, excluding electricity and water bills.
2. That the Tenant shall not lease the property to a subtenant under any circumstances without the consent of the owner (landlord).
3. That the Tenant shall follow all the rules and regulations as per laws in respect of the rented property and will not do any activity which is not legal in the rented property.
4. That this agreement is granted for a period of …………. months starting from (date of rent commencing from) and this contract can be extended further after obtaining mutual consent of both the parties as per the rental value in the market.
5. That the Tenant shall pay the electricity and water charges on the basis of the consumption to the owner.
6. That the Tenant shall not be permitted to do construction in any way or form in the rented premises without the consent of the owner.
7. That the Tenant is not allowed to make any alteration/remodeling in the rented property without the written consent of the owner.
8. That the Tenant will have to allow the landlord or his authorized representative to enter into the rented premises for the examination which includes general checking required for restoration/ improvement in the premises (if needed).
9. That the Tenant shall not perform any activity that could cause problems/disturbance to the neighbors.
10. That the Tenant shall bear the cost for routine small repairs.
11. That this contract/agreement could be revoked before the expiry of this tenancy period by serving one-month notice in advance.
12. That the Tenant shall pay one month rent in advance to the landlord that would be further adjusted in the monthly rent.
13. That both the parties to the contract/agreement have read and understood the clauses of this agreement and have agreed to sign the same.
