What are the eligibility criteria for International Patent Protection in Electronics and IT?

Eligibility criteria for International Patent Protection in Electronics and Information Technology:

  1. The applicant for the patent protection should have registered The company under the MSME Development Act 2006.
  2. The registered company must fulfill the requirements for investment in the plant and machinery as prescribed in the MSME Development Act 2006. The company must comply with the amendments as they are implemented from time to time.
  3. The applicant should establish a software technology park Unit registered and fulfill the requirements as per the Act, recognizing the evidence of such registration and the recent audited balance sheet of the applicant.
  4. The applicant must be a technology incubation enterprise or a startup established in an incubation hub and registered company.                                                                                              

What is the application procedure for International Patent Protection in Electronics and IT?

Applicants can apply online, which is more convenient. The steps to apply are as follows: 
Step 1: Check for the list of eligibility criteria whereafter, if all the terms and conditions are fulfilled, proceed to the next step.
Step 2: A Login ID is required, to which further communications shall be made.
Step 3: On creating a user account, Login and Apply Online for the Scheme. 

While carrying out the application procedure, make sure the following documents are kept handy:

  1. Registration documents.
  2. The most recent Audited Balance Sheet scanned.
  3. For an application for Waiver under sec. 39 of the Indian Patent Act for international filing, then the document of Official filing with the Indian Patent office in scanned format.
  4. If the filing is for international registration, then proof of filing follows the Paris Convention Treaty or direct international filing.
  5. If the applicant is a member of the board of directors or an employee, to support that, they shall provide scanned documents as proof.
  6. A technical summary in the written format of the invention should be attached in pdf format. The PDF file should be in downloadable form.
  7. Report on Patent Search.                                  
  8. Details for the transfer of e-Payments or any other payment documents in hard copy should be converted in scanned format.
  9. A declaration form should be filled, signed, scanned, and attached for the filing procedure.                          

Why is support for International Patent Protection in Electronics and IT important?

Applications must be filed within 12 months from the date of filing the convention application in India in a foreign country. Of the total expenses incurred in the filing procedure of the patent application, the reimbursement of 25% initially. The remainder, i.e., 75% of the costs incurred, will be refunded after the patent.
